Please read these Terms of Service ("Terms") carefully before using Astryk (the "Service"), operated by John Overton dba Astryk ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Alpha Status and Acceptance

1.1 Alpha Software

Astryk is currently in alpha testing phase. This means:

The Service is provided on an experimental basis
Features may change, be added, or removed without notice
The Service may contain bugs, errors, or instabilities
Data loss or corruption may occur
Service availability is not guaranteed
Performance and reliability may vary

1.2 Acceptance of Terms

By creating an account or using the Service, you acknowledge that you understand and accept the alpha status of the Service and agree to these Terms.

2. Use at Your Own Risk

IMPORTANT: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

Security breaches
Software bugs or errors
Compatibility issues

We strongly recommend that you maintain backup copies of any important data you store in the Service.

3. User Accounts

Notifying us immediately of any unauthorized use of your account

4. User Content and Intellectual Property

4.2 License to Astryk

By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

Store, process, and display your User Content as necessary to provide the Service
Make backup copies of your User Content for data protection purposes
Use anonymized and aggregated data derived from your usage for Service improvement

This license exists solely to enable us to provide and improve the Service. We do not claim ownership of your User Content.

5. No Warranty and Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY
UNINTERRUPTED OR ERROR-FREE OPERATION
SECURITY OR DATA PROTECTION

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

YOU CANNOT SUE US FOR ANY SERVICES, DATA LOSS, OR OTHER DAMAGES.

IN NO EVENT SHALL JOHN OVERTON DBA ASTRYK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR USE
BUSINESS INTERRUPTION
COST OF SUBSTITUTE SERVICES

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You may request deletion of your account and associated data by submitting a request through our feedback form or by emailing astryk@jroverton.com.

8. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kansas, United States, without regard to its conflict of law provisions.
